Woman to be awarded $5.2M from GEICO after catching STD from boyfriend in car

A woman in Missouri is to be awarded $5.2 million from a car insurance agency after catching an STD from her boyfriend while having unprotected sex in his car.
According to the report, the woman only identified as Jackson County resident M.O., sued her former boyfriend’s insurance company GEICO, after she contracted HPV from him.
She contacted the insurance company in February of 2021 alleging that an insured member knowingly gave her the virus and that she was seeking monetary damages from the company.
GEICO denied her case and sent it to arbitration.
An arbitrator saw the case in May of 2021 and found that the insured was liable for not disclosing his infection status and awarded the victim $5.2million to be paid by GEICO.
After hearing the settlement, GEICO attempted to undo the action, however, a three-judge panel ruled on Tuesday that the judgment issued through earlier arbitration proceedings was valid.
GEICO argued that the finding violated the company’s rights to due process but the panel ruled that no mistake was made and the company did not have a right to “relitigate those issues” once damages had been determined and a judgment was entered.
In a separate opinion, Judge Tom Chapman wrote that he believes GEICO had “no meaningful opportunity to participate” in the lawsuit and existing law “relegat(es) the insurer to the status of a bystander.”
