The suspect who was convicted for the rape and murder of an 11-year-old girl in 2004 has reportedly died in prison.

The Attorney General’s Office reported that Joseph Smith died Monday in a Sarasota prison while awaiting another trial for the death penalty.
In 2004 Smith reportedly abducted Carlie Brucia as she walked home from school.
Surveillance video from a nearby carwash showed Smith leading her by the wrist down a sidewalk. He later would rape and kill the child.
Smith was sentenced to death row, however, in order for death penalty to be carried out juries must be unanimous. The jury in 2005 voted 10-2.
A resentencing hearing was scheduled for next year before the announcement of his death.
It is unclear how Smith died.
