For the first time ever, a sitting president, Donald Trump, has suggested delaying the presidential election set for November 3rd. President Trump on Twitter this morning raising the idea of delaying November’s election, writing that mail in voting would lead to what he believes will be quote “the most INACCURATE & FRAUDULENT Election in history.” The president asking quote: “Delay the Election until people can properly, securely and safely vote???”

But the President has no authority to reschedule the general election per Federal law set in 8145 which stipulates that it always be held on the first Tuesday of the month of November. To move the election, Congress would have to pass new legislation to change the voting schedule, something experts say is extremely unlikely but not impossible given the constraints of the coronavirus pandemic.
