The Palm Beach County Sheriff’s Office has arrested a 57-year-old man who allegedly beat up his neighbor over an argument about a trash can.

The incident was reported around 6:40 p.m.

The victim told authorities that when is neighbor Terry Carter got home from work, he immediately grabbed the victim’s trash can kicked it across the driveway. When the victim heard the noise, he grabbed two cable locks and went outside to lock the trash can to the fence to prevent Carter from kicking it over.

As the victim began locking the trash can to the fence, Carter came running down the driveway yelling and then pushed the victim. The victim fell and that’s when Carter grabbed one of the cable locks. The victim told police that he was afraid Carter would hit him with the lock so he got up and started walking towards his own driveway.

That’s when the victim turned and saw Carter swinging the lock and was then hit by the lock. Carter allegedly repeatedly hit the victim with the lock before returning to his driveway.

The victim told police that he and carter had an ongoing issue with the placement of the trash can.

When authorities spoke to Carter about the incident, Carter told them that the victim was blocking the door to his fence and he asked him to move out of the way but instead the neighbor sprayed him with pepper spray which prompted him to hit the victim with the lock.

The officer then asked why Carter did not just call the police if he was pepper sprayed, and that’s when Carter stopped answering questions.

Carter was taken to JFK Medical Center for clearance before he was taken to jail.

He is now facing charges of battery on a person over 65 and aggravated battery on a person 65 and older.
