Former Stuart teacher guilty of sexual battery on student

A Stuart area middle school teacher has been found guilty of sexual battery on a student.

29-year-old Jeffrey Tomasulo received a guilty verdict on Thursday by  Martin County jurors for the incident that occurred in 2018.

According to the report, the student told her mother that she’d given Tomasulo oral sex on several occasions while in a locked classroom, alone with him.

He also is accused of watching porn in the classroom.

Tomasulo’s attorney argued that his client was alone in the classroom with the student because he was tutoring her and that they locked the door due to security concerns.

The attorney also reported that he did not believe there was enough evidence to convict his client of the crime.

“There is a lack of evidence in this case and as a result, he needs to be found not guilty of all charges,” attorney Flynn Bertisch said.
Jurors were shown school security footage, interrogation clips, and more to prove Tomasulo was guilty.

Prosecutors especially zeroed in on jail phone conversation between Tomasulo and his wife where she questioned him about the incident and he never once denied that it occurred.

“He doesn’t take that time to say, ‘This isn’t me, you know me, I wouldn’t do these things.’ He says, ‘I’m sorry. I’m sorry I ruined everyone’s life. Don’t give the baby my last name,” said Assistant State Attorney Kristen Chase.

Tomasulo has been found guilty on one count of sexual battery on a child.
