MELBOURNE, FL– A 39-year-old man is facing DUI charges after he was found intoxicated and driving a motorized scooter around a Walmart. 

The incident occurred on Sunday. 

Brevard County police say they were called to the store after customers and employees noticed the suspect, Aaron Gregory swaying in the scooter, running into shelves, and at some points, almost running into other customers.  

Authorities say Gregory smelled of alcohol and also had an open backpack in the basket of the scooter, that had a visible bottle of Smirnoff inside. 

When authorities arrived, Gregory was unresponsive in the scooter. He was then taken by stretcher out to the patrol vehicle where he reportedly refused to take a breathalyzer test. 

Gregory was taken into custody and booked into the Brevard County Jail. 

He is facing several charges including DUI, refusal with prior citation, disorderly intoxication, and possession of an open container.
