
TALLAHASSEE- A judge in Leon County issued a temporary injunction against Florida’s new abortion law, which went into effect on Friday and bans abortions for women who are more than 15 weeks pregnant.
The state of Florida filed an appeal to Judge John Cooper’s ruling on Tuesday, which puts the law back into effect until a final ruling is issued.
Planned Parenthood of Central Florida filed the lawsuit in an attempt to block HB-5, contending that the state Constitution protects a woman’s right to an abortion.
Cooper sided with the abortion provider saying the new law indeed violates the Florida state Constitution’s privacy clause.
The U.S. Supreme Court recently ruled that the U.S. Constitution does not guarantee the right to an abortion.
A ruling on the Florida lawsuit could be issued this week.
