HOLLYWOOD, FL–
A Broward teen who just turned 15-year-old earlier this month, will be tried as an adult in a rape case.
Officials say Terry Berger Smith reportedly attacked and raped a woman on June 10th as she walked home from work in the 300 block of South Park Road.
The victim told investigators that Smith said he’d been watching her and wanted to add her to his “collection. “
After raping the victim, Smith reportedly moved her to another location and lived part of the situation to a friend.
Broward State Attorney Harold F. Pryor says he decided to charge the teen as an adult due to the nature of the crime and the fact that a maxium sentence for a juvenile is three years.
Pryor also reported that Smith has a prior violent criminal history and was recently released from a juvenile detention facility in New York.
“I have to prioritize the safety of the community and make these kinds of decisions after reviewing all of the evidence and circumstances,” Pryor said in a statement Friday. “This person already went through the juvenile system in New York for a very disturbing violent incident and was committed to a juvenile facility there for 18 months. Upon release, he relocated to Broward County.”
Smith is facing four counts of sexual battery and one count of kidnapping.
