AirBnB guest shot by home’s neighbor while walking to grocery store

(North San Jose, CA)– A 21-year-old man is recovering after he was shot by another man while exiting an AirBnB.
The incident was reported on Oct. 2nd in Santa Clara County.
According to the report, the victim exited the Airbnb and crossed the street while on the way to a nearby grocery store.
The victim then saw 66-year-old Mark Waters exit a nearby home holding a black handgun.
Officials say the victim attempted to run to safety but was shot in the back of the leg by Waters.
The police were called and the victim was treated at the scene before being taken to an area hospital with serious injuries.
Investigators retrieved surveillance video from the scene and reported that the attack was unprovoked and the victim was unarmed.
Waters was taken into custody and multiple firearms were seized from his home.
He is charged with felony assault with a semi-automatic firearm resulting in great bodily injury and personal use of a firearm, according to a press release from the District Attorney’s Office on Dec. 9.
“Everyone should be safe walking to the store,” said District Attorney Jeff Rosen. “We will not tolerate such senseless and violent acts in this County. We wish the victim a speedy recovery and will make sure he receives justice for this brutal assault.”
Waters may face additional charges as authorities are investigating potential hate crime allegations.
