A 7-year-old New York boy is now facing rape charges after an incident that occurred around Thanksgiving of last year.
While many of the details surrounding the case are unknown at this time, the family’s attorney Anthony Martone, told reporters that he does not believe the child truly understood what he was doing:
“Instinctually, it shouldn’t happen to a 7-year-old. I don’t think you could even realize what you’re doing at 7 years old, so I think it’s absurd to charge a 7-year-old with rape.” He continued, “They’d have to prove he actually physically committed this act, which to me, it almost seems to be an impossibility.”
The child is now facing a third-degree rape charge. If he is charged he will be charged as a juvenile delinquent according to reports.
Advocates in New York are currently working to raise the age at which a child can be considered a juvenile delinquent from 7-years -old to 12-year-old.
